I designed a mock version of OBEY's logo which says OHEY but has the same big white type inside a red oblong. The idea was just an impulsive sketch that I personally did over summer in the back of a sketchbook. People seem to like the design and Marty and I wanted to print it because of its popularity. However, we were concerned about the legal ramifications and weather we would get in to any sort of trouble.
We spoke to John about it and explained that I created the design as a drawing and then from scratch on illustrator. It was never copied from and image of the OBEY logo and OHEY is not our company name or logo either and it would just be a one off design.
John was really helpful and reassuring about it all and did the research that we couldn't because we didn't know how to go about investigating such a thing. He basically told us that it would be fine to print it and sell it so long as it has something on it that makes it a tribute design to OBEY such as the word 'homage'. It could be really small and almost unreadable if need be. Alternatively we could leave it and if OBEY were to contact us, then they would have to prove that we are doing significant damage to their brand and/or business. As we would only be printing a handful of shirts we wouldn't be doing any damage at all. Furthermore if OBEY we to ask us to stop printing them we could just say 'Yes ok' to save any dispute.
